99.1 The Ranch Broadcast Sponsorship is NOT an Event Sponsorship – For clarification and to protect the event owners/hosts, 99.1 The Ranch / Strategic Communications Group must ensure that our Broadcast Sponsors understand that your sponsorship
does not include an Event Sponsorship with the Operator/host organization. Your support is solely for the promotional broadcast items listed above. The Broadcast Sponsorship does not include Event Sponsorship items offered by the event owner/host which may include; advertising banners, branding on clothing, press and public relations drives, merchandising, promotions, booth space or event access. 99.1 The Ranch encourages our Broadcast Sponsors to contact the host organization to inquire about Event Sponsorship options.
*Commitment: For our monthly airtime sponsorships, we request you stay on as a sponsor for at least twelve months but if you need to cancel your sponsorship, due to script writing, voice over, scheduling, studio and production costs, we need you to stay on for a minimum of four months and give a minimum 30-day cancelation notice. 12 Month commitment MUST be honored when airtime sponsorship is tied to Ranch Friday Night Lights Football Broadcast Sponsorships.
Legal: Strategic Communications Group is authorized to operate KWSV-LP noncommercial broadcast station on an assigned frequency of 99.1 mHz. Pursuant to the rules and regulations of the FCC, the parties to this agreement acknowledge that the Station is permitted to broadcast underwriting and sponsorship announcements from for-profit entities, but is not permitted to broadcast commercial advertisements by for-profit entities. In the event the listed referenced SPONSOR/UNDERWRITER is a bona fide non-profit entity, the Station is permitted to broadcast commercial advertisements on behalf of the SPONSOR/UNDERWRITER.
Broadcast Announcements: “99.1FM The Ranch” will provide a copy of the broadcast announcement(s) governed by this Agreement. “99.1 The Ranch” has final editorial control of content of the announcement(s) and may revise, reject or terminate any such announcement(s) in order to maintain good faith compliance with relevant FCC rules and regulations.
Emergency Programming: “99.1 The Ranch” retains the right to interrupt or preempt any announcement covered by this Agreement at any time in case of emergency, or to broadcast other announcements or programs, if in its editorial discretion, to do so would best advance the Station’s public interest responsibilities.
EVENT OF FORCE MAJEURE: "Event of Force Majeure" means an event beyond the control of 99.1 The Ranch / Strategic Communications Group and the Operator/
host organization, which prevents a Party from complying with any of its obligations under this agreement, including but not limited to: 1.1.1 Act of God (such as, but not
limited to, fires, explosions, earthquakes, drought, tidal waves and floods);1.1.2 war, hostilities (whether war be declared or not), invasion, act of foreign enemies,
mobilization, requisition, or embargo; 1.1.3 rebellion, revolution, insurrection, or military or usurped power, or civil war; 1.1.4 riot, commotion, strikes, go slows, lock outs or disorder, unless solely restricted to employees of the Supplier or of his Subcontractors; 1.1.5 pandemic/ outbreak and associated mandates or restrictions: or 1.1.6 acts or threats of terrorism. 99.1 The Ranch/Strategic Communications group will “Make Good” with equivalent branding.
“Strategic Communications Group”, “99.1 The Ranch”, and “KWSV-LP”, is in no way making an offer for “commercial advertising”. This agreement between the
SPONSOR/UNDERWRITER is for acknowledgement of their charitable support of “99.1 The Ranch”.
This Agreement shall be governed by, interpreted and enforced in accordance with the laws of the State of California and shall be executed in the County of Ventura. This
is the entire agreement of the parties in regard to these matters. There are no oral agreements existing between them.
